Terms of Use Agreement

1. ELIGIBILITY

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this site, upload content, or purchase our services.

2. OUR SERVICES

Ai Dream Makers provides digital creative services, including real estate virtual staging and photo enhancement, AI-generated actor casting and character look designs, and video thumbnail design, among other AI-assisted media services offered on this site.

3. USER CONTENT & UPLOAD LICENSE

When you upload images, text, logos, or other assets ("User Content") to our site via our file uploader, you guarantee that you own the rights to those files or have explicit permission to use and modify them. You grant E & R LLC a worldwide, non-exclusive, royalty-free license to use, modify, process, and replicate your User Content solely for the purpose of fulfilling your order.

For Actor Casting & AI Character Looks specifically: uploaded images must depict you, the purchasing customer, only. You may not upload images of any other identifiable individual. Reference images of celebrities or public figures for style/inspiration purposes are permitted only where the Company determines such use is legally permissible, and are used at the Company's sole discretion - the Company may decline to use any reference image for this reason.

4. PROHIBITED USES & RIGHT TO REFUSE SERVICE

You may not use our services to request or create content that:

• Depicts any real, identifiable person other than yourself without that person's explicit consent, including public figures or celebrities, except where the Company has determined such use is legally permissible;
• Is intended to deceive, defame, harass, bully, or impersonate any person or entity;
• Depicts minors in an inappropriate, exploitative, or sexualized manner;
• Infringes any third party's intellectual property, privacy, or publicity rights;
• Is pornographic, hateful, discriminatory, or promotes violence; or
• Is otherwise unlawful or violates the policies of the third-party AI tools and platforms the Company relies on for production.

The Company reserves the right, in its sole discretion, to refuse, decline, cancel, or discontinue work on any order it believes violates this section or is otherwise immoral, unethical, or illegal, and to report unlawful content to appropriate authorities. If the Company declines or cancels an order under this section before production has begun, you will receive a full refund. If a violation of this section is discovered after production has begun or been delivered (including where you made a false representation under Section 3), the Company may cancel the order and withhold delivery or revoke access to delivered files without refund.

5. REFUND AND REVISION POLICY

Due to the digital, custom nature of our creative services and the immediate technical labor involved, all sales on completed and delivered orders are final, and the Company does not offer refunds for delivered work.

• Revision Limit: Every purchase across all services includes exactly one (1) free round of revisions.
• Strict Time Limit: All revision requests must be submitted within five (5) days of receiving your final delivered files. After five (5) days, the order is considered closed, finalized, and approved.
• Scope: Revisions must strictly align with the original order instructions. Submitting new base photos, changing text hooks, or requesting an entirely different design style after work is completed will require a new purchase.
• Non-Delivery: If the Company fails to deliver your order within the stated turnaround window (plus any agreed extension) without valid reason, your sole remedy is a full refund or re-delivery, at the Company's discretion.

6. SERVICE-SPECIFIC TERMS

• Real Estate Staging: Revisions cover minor adjustments to staging furniture, grass enhancement adjustments, sky replacement changes, or further item removal.
• Actor Casting & AI Looks: Our character looks showcase casting range, wardrobe, and archetypes, using only images you have uploaded of yourself (see Section 3). While we optimize for realism, digital/AI modifications can alter minor facial nuances. We do not offer refunds if you dislike the creative output or interpretation of the archetype.
• Video Thumbnail Design: All custom thumbnails are delivered strictly as flattened, high-resolution .JPG or .PNG images. Layered source files (such as .PSD files) are not provided.

7. DELIVERY METHOD & FILE ACCESS WINDOW

Completed files are delivered via a secure download link (currently Google Drive), accessible for sixty (60) days from the date of delivery. It is your responsibility to download your files within this window. Requests for re-delivery after the 60-day window has closed may be subject to a re-delivery fee. Uploaded source files are retained for sixty (60) days following order completion and are then deleted from our systems. See our Privacy Policy for further detail.

8. AI-GENERATED CONTENT DISCLOSURE

Ai Dream Makers uses artificial intelligence tools as part of its production process for the services offered on this site. Final deliverables are AI-assisted or AI-generated creative works. It is your responsibility as the customer to label visuals as AI-generated where required by law or industry regulations. For Actor Character Looks, it is advised that you state on your image that it has been "AI Generated" or is a "Concept Image Only." If requested in writing, we can add a text label on visuals stating "AI Generated."

9. PORTFOLIO & MARKETING USE

We do not use your uploaded content or delivered work in our portfolio, website, or marketing materials unless you affirmatively opt in. At checkout (or upon delivery), you will be given the option to grant AI Dream Makers a non-exclusive, royalty-free right to display your before/after images and finished deliverables in our portfolio, website, and marketing materials. You may withdraw this permission at any time by contacting hi@AiDreamMakers.com, though we cannot retract material already published or distributed prior to your request.

10. USER ACCOUNTS

If you create an account, you are responsible for:

• Maintaining login confidentiality
• All activity under your account

We reserve the right to terminate accounts that violate these Terms.

11. COMMUNICATIONS & SMS/EMAIL CONSENT

By providing your contact information, you agree to be contacted by AiDreamMakers.com via call, email, and text regarding your orders and our image, video, and visual content services. This may include recurring automated marketing and transactional messages; consent to marketing messages is not a condition of purchase. Message and data rates may apply, and message frequency may vary.

• To opt out of texts: reply STOP at any time. For assistance, reply HELP or email hi@AiDreamMakers.com.
• To opt out of emails: use the unsubscribe link in any email.
• We do not sell or share your mobile number for third-party marketing. Carriers are not responsible for delayed or undelivered messages.
• Note: AiDreamMakers.com may be unable to respond to inquiries or process orders without operational (transactional) communication permission.

12. INTELLECTUAL PROPERTY & FINAL DELIVERY

Upon full payment and final delivery, E & R LLC grants you a perpetual, non-exclusive, royalty-free license to use the final delivered flattened images (.JPG/.PNG) for your personal or commercial business needs (e.g., real estate listings, casting submissions, YouTube channels). E & R LLC retains ownership of any internal design templates, AI workflows, or proprietary methods used to create the assets.

The copyright status of AI-generated or AI-assisted content is an evolving area of law, and in some cases such content may not be eligible for copyright protection at all. The Company makes no representation or warranty regarding the copyrightability of any AI-assisted deliverable.

13. DISCLAIMER OF WARRANTIES

Our services are provided "as is" and "as available." The Company makes no warranty that any deliverable will achieve any particular business, creative, casting, or marketing outcome, including but not limited to real estate sale price or timeline, casting selection, or content performance.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by law, E & R LLC, its owners, and employees shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services, including but not limited to casting rejections, real estate listing issues, or YouTube channel performance. Our maximum liability to you for any reason shall be limited to the total amount paid by you for the specific service ordered.

15. INDEMNIFICATION

You agree to indemnify and hold harmless E & R LLC, its owners, and employees from any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from: your User Content; your breach of these Terms, including Sections 3 and 4; or your misuse of delivered files.

16. FORCE MAJEURE

The Company is not liable for delays or failures in performance caused by events beyond its reasonable control, including outages or disruptions of third-party AI tools, payment processors, or other service providers the Company relies on for production or delivery.

17. PRIVACY POLICY

Your use of this Website is governed by our Privacy Policy.

18. GOVERNING LAW

These Terms are governed by the laws of the State of Utah. Any disputes shall be resolved in the state or federal courts located in Utah.

19. SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and Refund & Revision Policy, constitute the entire agreement between you and AI Dream Makers regarding your use of the site and services.

20. CHANGES TO TERMS

We may update these Terms at any time. Continued use of the Website constitutes acceptance of revisions.
